The mediator is chosen by mutual agreement between the parties. He must have
knowledge of law, psychology, sociology, to know specific methods and
techniques based on communication and negotiation. Decision related to a
certain aspect connected to the dispute belongs exclusively to the parties,
the mediator only facilitating the process.
The mediator has the right to receive an honorarium, established through
negotiation with the parties, as well as to recover the costs appeared
further to the mediation.
Honorarium has to be acceptable, to take into account the nature and the
object of the conflict, as well as the number of involved parties. If not
otherwise agreed, honorarium is paid equally by the parties.
